The students waited until the following afternoon to call for medical help once his condition had worsened, and even though a district attorney cleared the classmates of any wrongdoing last year, his parents filed a lawsuit against his roommate and others who were present for wrongful death. The parents of a year-old boy whose skull was crushed by a falling tree limb at Lake Merritt sued the city of Oakland for wrongful death Monday, saying city workers knew the tree was decayed but failed to remove it or warn the public.
